General terms of use

These General Terms of Use (hereinafter “GTU”) have been established by EDITIONS QUO VADIS, a French Simplified Public Limited Company, with a share capital of €4,671,000, registered with the Trade and Companies Register of Nantes under number 054 807 748 with a registered office located 14, rue du Nouveau Bêle 44470 Carquefou, France.

These GTU apply to any User of the following websites:

(hereinafter referred to as the “Sites”).

Any person using the Sites (hereinafter referred to as the “User” or “Users”) may consult the GTU, available on the Sites, at any time.

EDITIONS QUO VADIS reserves the right, at its sole discretion, without prior notice, to modify these General Terms of Use, at any time. These changes are effective immediately, as soon as they are published on the Sites. Users are invited to regularly consult the GTU.

  • Definition

  • Quo Vadis Corporate Website accessible via the URL http://quovadis1954.uk: presentation site of Editions Quo Vadis, its activities, products, sites, blogs, mobile applications.
  • Quo Vadis Store accessible via the URL http://store.quovadis.eu/en: Quo Vadis Online Store
  • Quo Vadis Factory accessible via the URL http://quovadisfactory.com: offering online customised calendars and other personalised stationery products.

User: Internet user navigating one or all of the Sites. Any minor or protected adult using the Sites is confirming that they have received the consent of their parent or guardian to do so.

  • Intellectual Property

The Sites are protected by intellectual property rights such as copyright, patent, trademark laws, design law, on both the content (agenda grids, page templates, codes, texts, graphics, photos, videos, sound tracks, etc.) and the structure (selection, plan, arrangement, means of access to data, etc.).

Editions Quo Vadis is the exclusive owner of all intellectual property rights on the Sites.

In accordance with the provisions of the Intellectual Property Code, solely a private use is authorised. Any other use constitutes infringement and is sanctioned by intellectual property law.

Trademarks are protected by trademark laws. Any full or partial reproduction of these trademarks or logos on the basis of the elements of the Sites without the express authorisation of EDITIONS QUO VADIS is prohibited and may be sanctioned by intellectual property law.

  • Liability

Under no circumstances can EDITIONS QUO VADIS be liable for unavailability, interruption or malfunction of the Sites.

Under no circumstances shall EDITIONS QUO VADIS be liable for indirect, consequential and/or immaterial damages.

Under no circumstances shall EDITIONS QUO VADIS be liable for direct or indirect damages resulting from an inappropriate or non-compliant use of the Sites.

The User agrees to be personally responsible and not to hold EDITIONS QUO VADIS liable for actions and/or claims of third parties due to content that they disseminate.

The User cannot save or transmit data that infringes the intellectual property rights of other persons.

The User undertakes to comply with all applicable laws, rules and regulations in force and not to use the Sites in contravention of any law, rule or regulation. The User acknowledges that they are aware that data deemed as contravening the laws, rules or regulations in force may be submitted by EDITIONS QUO VADIS to the law enforcement authorities, which will process them accordingly.

  • Links to other Sites

The Sites may offer links to other EDITIONS QUO VADIS websites or even to third party websites, which are not owned or controlled by EDITIONS QUO VADIS. EDITIONS QUO VADIS has no control over and cannot be held liable for the content, privacy policies, data protection and practices of third party sites. By clicking on these links, the User leaves the Sites and is therefore no longer subject to these GTU. The User is requested to read the general terms of use and privacy and data protection policies of each of the sites they visit.

  • Governing law/Jurisdiction

These General Terms of Use are governed and interpreted by the laws of France and exclusive jurisdiction is given to the Courts of Nantes.

 

Privacy policy

EDITIONS QUO VADIS has established this privacy policy to communicate about directly or indirectly identifying data that it collects from the User, to provide the services linked with the use of its Websites, namely:

1/ Definitions:

Responsible for the processing of personal data: EDITIONS QUO VADIS is a simplified joint-stock company with a capital of €4,671,000 registered with the Nantes Company Register under the unique identification number 054 807 748, whose headquarters is located at 14, rue du Nouveau Bêle 44470 Carquefou, France, and is responsible for processing personal data collected from the User.

Sites: The following 3 sites edited by Editions Quo Vadis:

User: Internet user navigating one or all of the Sites. Any minor or protected adult using the Sites is confirming that they have received the consent of their parent or guardian to do so.

2/ User consent:

The User shall read the current privacy policy and automatically agrees to its terms by using the Sites, agreeing to provide their personal data when required, or ticking the User agreement box.

The User’s directly or indirectly identifying data is processed in France without transfer outside of France. If, however, the data must be transferred to a country outside of France or even outside of the European Union where data protection regulations are less strict than in France, EDITIONS QUO VADIS shall subject the recipient of the data to the rules of this privacy policy on behalf of the User.

3/ Security measures to protect data privacy

EDITIONS QUO VADIS shall take appropriate security measures to protect the User’s personal data in its possession against accidental or deliberate alteration, loss, destruction and unauthorised access. However, EDITIONS QUO VADIS cannot guarantee flawless security when sending data over the internet. The User is responsible for taking all appropriate measures to protect their data and/or software from any viruses circulating on the internet.

4/ Personal data likely to be collected

To access the various services offered on the Sites with a single username, the User must create a personal account by entering their surname, first name, email address and password.

To place an order on the Quo Vadis Store and/or the Quo Vadis Factory, the User must provide the following information: last name, first name, delivery address, billing address (if different) and telephone number. This information is necessary for managing the User’s order. The other information is optional.

Regarding the Quo Vadis Factory, the User may also register information, and thus potentially personal data, in the designated fields for products they wish to customise.

When the User communicates with EDITIONS QUO VADIS using the “Contact” section on the Quo Vadis Corporate Website or by email, the User must enter their email address so that EDITIONS QUO VADIS can respond to their request. EDITIONS QUO VADIS may collect information from these messages. The User may choose not to provide certain pieces of information, but the services rendered may be limited by this.

5/ Use of personal data

EDITIONS QUO VADIS will use the User’s personal data collected during the creation of their personal account to provide them with the services offered by the Sites and to give them access to all these services under a single username. If the User gives their consent by ticking the designated box, EDITIONS QUO VADIS will also be able to use the User’s personal data for a period of three years to send them newsletters, promotional or advertising material and to inform them of new features on the site and new products.

EDITIONS QUO VADIS will use the User’s personal data collected through the Quo Vadis Store or the Quo Vadis Factory to register, prepare, deliver and track their order. This data will be stored for a period of five years starting from the User’s last order to comply with current laws and regulations, prevent fraud and/or settle disputes. Orders over 120 euros will be stored for a period of ten years in accordance with current regulations.

Regarding Quo Vadis Factory, EDITIONS QUO VADIS will use the User’s personal data collected while customising a product to manufacture the customised product ordered by the User. This data will be stored for a period of three years starting from the User’s last order to allow them to retrieve this data if they wish to place a new order.

EDITIONS QUO VADIS will use the User’s personal data collected while using the “Contact” section of the Quo Vadis Corporate Website to respond to the User’s request. This data will be stored for a period of three years starting from the User’s last request.

EDITIONS QUO VADIS will be able to communicate with the User by sending alerts and emails in push mode to inform them specifically of any changes to the current Privacy Policy. The User may choose to stop receiving these messages by clicking the “unsubscribe” link found at the bottom of each email. If the User unsubscribes, they will only receive messages pertaining to their orders.

EDITIONS QUO VADIS may also use the User’s personal data to create anonymous information databases in which the User is no longer identifiable.

6/ Data disclosure

A – Disclosure of personal data

Subject to the current legislation for personal data processing and, if necessary, with the User’s consent, their personal data may be disclosed to the following recipients:

  • any company which may acquire EDITIONS QUO VADIS and shall comply with the current Privacy Policy;
  • third party service providers subcontracted by EDITIONS QUO VADIS for transport services for ordered products, online payment processing, hosting, outsourcing and maintenance of Sites and servers, and data analysis;
  • third party service providers in charge of promotional or advertising activities when the User has consented to receiving newsletters or commercial prospecting by ticking the designated box; and
  • administrative or judicial authorities to comply with a request made by the authorities, by a judicial decision and/or by a law or regulation.

Users’ personal data may only be disclosed to third parties for direct marketing purposes with the express consent of the Users.

B – Disclosure of anonymous data

EDITIONS QUO VADIS is authorised to publicly disclose anonymous data without restriction.

7/Third party sites

The Sites may contain content or links to other sites that are not monitored by EDITIONS QUO VADIS. By clicking these links, the User leaves the Sites, and their personal data may then be collected by these other sites in accordance with their own privacy policy. The User is invited to read the personal data protection policies or privacy policies of each site visited.

8/ User’s rights over their personal data

The user has the right to access, rectify and delete data pertaining to them. They may exercise this right:

  • for the personal information relating to their personal account: by amending their data directly on their personal account or by sending a message to the following address: contact-compte@quovadis.eu.
  • for the personal data collected as part of the Quo Vadis Store: by sending a message to the following address: contact-compte@quovadis.eu
  • for the personal data collected as part of the Quo Vadis Factory: by sending a message to the following address: contact-factory@quovadis.eu

The User may request the deletion of their account at any time. In such cases, their personal data will only be stored by EDITIONS QUO VADIS to comply with current laws and regulations, prevent fraud and/or settle disputes.

9/ Changes to the privacy policy

The current Privacy Policy may be amended at any time. Any new version with minor changes having no consequence on the User’s rights will be published by EDITIONS QUO VADIS and will apply immediately. In the event of major changes having consequences on the User’s rights, they will be informed by email about the publication of a new version of the Privacy Policy and invited to read it. In case of disagreement with these terms, the User may request the deletion of all personal data pertaining to them. In such cases, their personal data will only be stored by EDITIONS QUO VADIS to comply with current laws and regulations, prevent fraud and/or settle disputes.

The User is informed that, in order to improve performance in terms of satisfying the needs of their customers, the Sites are likely to use cookies. EDITIONS QUO VADIS collects the User’s consent for the use of these cookies by means of a banner.

EDITIONS QUO VADIS cookies

EDITIONS QUO VADIS may use cookies on the Sites to track User behaviour on the Sites, thereby improving the User’s experience and providing them with more relevant information. Cookies enable online stores to identify the User and access their account, store their cart contents and continue their order, store their consultations and customise the offers that EDITIONS QUO VADIS sends them. They can also be used to adapt the presentation of the Sites to the display preferences of the User’s terminal (type of terminal, country, etc.). By disabling these cookies, the User is likely to encounter browsing problems while placing their order.

Third party cookies

EDITIONS QUO VADIS uses third party tracking services such as Google Analytics to track and analyse anonymous information from Site Users. This anonymous information does not enable Users to be identified.

These third party firms may use cookies to establish statistics on the frequency of visits and use of the various elements comprising the Sites (sections and content viewed, routes). This information is used to improve the interest and ergonomics of EDITIONS QUO VADIS services and to address performance problems. This cookie policy does not cover the use of cookies by third party tracking service companies. EDITIONS QUO VADIS does not have access or control over these cookies. However, it ensures that the partner companies agree to process the information collected on the Sites in strict compliance with the regulations in force on data privacy, and undertakes to implement adequate measures to secure and safeguard data privacy.
